Campaigners seek judicial review of the decision to permit 110 new homes on land off New Road, Littleborough
StopRussellHomes campaigners have commenced the process of seeking a Judicial Review of the Council’s recent decision to grant planning permission for the development of 110 new homes on land off New Road, Littleborough.
Spokesperson Tony Perkins explained: “We have sought legal opinion on whether we have grounds to seek permission for Judicial Review of the Council’s decision.
“We have provided our legal advisors with a detailed, and comprehensive, summary outlining reasons why we believe there are the grounds.
“Whilst Judicial Review cannot decide whether to reject or approve the planning application, it can quash the original decision, so the application has to be brought back to the Planning and Licensing Committee for redetermination.
“Cynics may question whether pursuing Judicial Review is worthwhile if a successful outcome will not result in the decision being overturned permanently.
“We would say that it is vitally important that the Council is challenged when a decision that will have a permanent and irreversible impact on the local environment and community, is thought to be illegal, unfair, and irrational.”
