Council enforcements for environmental offences

Between April and June 2017, the Council issued 36 formal warnings and 49 statutory notices for a variety of environmental offences.

The formal warnings were predominantly for offences contrary to the Prevention of Damage by Pests Act 1949 but also covered offences contrary to the Highways Act 1980 and dog fouling issues.

For the same time period, 49 statutory notices were served, largely for accumulations of waste on private land and predominantly for offences contrary to the Prevention of Damage by Pests Act 1949 but also covering offences contrary to the Environmental Protection Act 1980 and the Refuse Disposal (Amenity) Act 1978.

Two cautions were signed in connection with fly-tipped waste at Ashworth Road, Rochdale and Matthew Moss Lane, Heywood, with costs incurred by Rochdale Borough Council recovered.

Four individuals were due to appear before Manchester and Salford Magistrates’ Court on 27 June for a variety of environmental crimes. Two individuals appeared and were granted an adjournment until 18 July; two individuals failed to appear and so warrants without bail were issued by the Bench.

One of the warrants was executed last Thursday (6 July) and a hearing was scheduled for Tuesday (11 July) at which Natasha Daly, of Buckley Street, Heywood, pleaded guilty to one offence contrary to s34(2A) Environmental Protection Act 1990.

The second warrant has not yet been executed.
